1. Acceptance of Terms
By accessing or using the Docsmore platform ("Service"), operated by Docsmore LLC, you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use the Service.
2. Description of Service
Docsmore provides a cloud-based document management, fillable PDF creation, and electronic signature platform. The Service allows users to upload PDF documents, create fillable form fields, distribute documents for signing, and track submissions.
3. User Accounts
You must create an account to use certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify Docsmore LLC immediately of any unauthorized use of your account.
4. Electronic Signatures
Docsmore facilitates the collection of electronic signatures in compliance with the Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and the Uniform Electronic Transactions Act (UETA). By using the Service, you acknowledge that electronic signatures collected through Docsmore are legally binding to the extent permitted by applicable law.
5. User Content
You retain ownership of all documents, data, and content you upload to the Service ("User Content"). By uploading User Content, you grant Docsmore LLC a limited, non-exclusive license to process, store, and transmit your content solely for the purpose of providing the Service.
6. Prohibited Uses
You agree not to use the Service to: (a) upload or transmit any content that is unlawful, harmful, or infringes on the rights of others; (b) impersonate any person or entity; (c) interfere with or disrupt the Service; (d) attempt to gain unauthorized access to any part of the Service; or (e) use the Service for any fraudulent purpose.
7. Data Retention
Docsmore LLC retains your documents and submission data for as long as your account is active or as needed to provide the Service. You may delete your documents at any time. Upon account termination, your data will be deleted within 30 days unless retention is required by law.
8. Limitation of Liability
To the maximum extent permitted by law, Docsmore LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.
9. Modifications
Docsmore LLC reserves the right to modify these Terms at any time. We will notify users of material changes by posting the updated terms on the Service. Your continued use of the Service after such changes constitutes acceptance of the modified terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
